Stephen Miller’s legal group, America First Legal, has been making headlines for its relentless lawsuits against the US


government, and even the Trump administration itself. Despite Donald Trump’s election, the group’s litigation efforts haven’t slowed down, but rather shifted focus.

According to Axios, Miller is “setting policy from inside the White House” while America First Legal is “shaping policy from the outside” through lawsuits and complaints against corporations and government entities.¹ This dual approach has raised eyebrows, with some questioning the group’s motivations.

America First Legal has been involved in several high-profile cases, including a lawsuit against Hello Alice, an online platform for entrepreneurs, over its administration of grants limited to Black-owned businesses.² The group has also challenged election administration procedures in Maricopa County, Arizona, alleging violations of state election laws.

Miller’s group has been accused of “forum shopping,” seeking out favorable jurisdictions to file its lawsuits. However, the Arizona Supreme Court recently shut down one such attempt, ruling that the group’s lawsuit against Maricopa County must be heard in the county’s jurisdiction, rather than in a more conservative county.

As America First Legal continues to pursue its litigation agenda, it remains to be seen how its efforts will impact policy and governance in the US.
